Do Moderators/SM's/Admins ban on the with using their best judgment on the situation? Or do they ban just because you broke the rules?

No it doesn't matter, if you break the rules (regardless of the situation) you get banned / cautioned / punished.

Shouldn't members be punished/banned/warned on the basis of the situation rather than you acting like robots?

Can you suggest a situation not mentioned in the rules where a ban would be appropriate? If so then the rules are missing a clause on that issue.
What i'm saying is, all situations where a ban would be appropriate are outlined in the rules, so yes the SMs/admins have to use their judgement in deciding how serious the rule breaking itself is, but there arn't any cases where they would need to ban someone where it was not due to a rule infringement.

I'd expect a 3 week ban for spamming up the forum, sweaing constantly and PURPOSLY trying to swear and avoid the filter.

Now you tell me... Is that someone using their best 'judgement'?

I'd expect a 3 week ban for spamming up the forum, sweaing constantly and PURPOSLY trying to swear and avoid the filter.

You shouldnt get banned right away if you avoid the filter, unless you have been warned before or you are being offensive or rude towards others.

Which is precisely the 'judgement' of the moderators I'm talking about. I've been warned twice for using gender in it's correct term, for posting my skype contact (Before anyone on here said we wasn't allowed too) but I got cautioned like 4 weeks AFTER I had posted it. And for apparently posting obscene and vulgar images... (I'd like anyone to point out where I have posted these?!). The last one is where I said the song name PCD ( P_ _ _ _ Cat dolls) and I had NO intention of dirtyness or vulgar there but I was cautioned.

The rest I have are user notes apparently.

Rather than me swearing on purpose and actually trying to cause havvoc to the forum, I'm banned/cautioned/warned for minor things which if the moderators actually opened their eyes and read before thinking "OMG, LOLZ HE AVOIDED THE FILTER HE'S GONNA BE BANNED NOWZ!" Then they could actually spend more time trying to ban people who actually are a trying to spam/swear/cause stupidity and do bad things on the forum.

I usually don't proof read my posts, I type fast and because I'm doing a sports science class, I use the correct terminology for everything, I don't really say to my self "Oh, wait a second, I've used the right word for Gender, and because this forum doesn't check what we've wrote just that 'we wrote' it so we avoided it on purpose".

But it's not the fact that I wrote it I'm trying to get across it's the fact of the judgement used by the moderators upon giving me the warning/caution for it.

Shouldn't they have used their best judgment and thought "Right, he's not talking about anything sexual... He's just using the term for gender".
