Well next time you should borrow a brain and read the TOS so you know if you cancel youll have to pay the contract or your months fee... If you cant afford the server/vps for 12months dont buy it.

well if they are going to take legal action, it will cost more than what they are expecting for you to pay.

If you are not 18 then you have nothing to worry about dude... As long as the TOS didn’t say you have to have permission. How olds the owner?
well if they are going to take legal action, it will cost more than what they are expecting for you to pay.
The person who gets sued has to pay that...

some people don't understand when they say : "I'll sue you!".
It costs to take people to court to actually sue them. It costs money to even get a court apperence! It will cost like triple to money to sue somebody to get the money you need.
The message here is don't commit to something which you can't pay for. No excuses.

Oo dear!!, why dont u like try and get a job for 2 days and then get 50 £. Lol its a idea :D. Run to the nearest town and try to get a job!
You dont need to go a court as such... You can take someone to a small claims court witch doesent cost alot and claim the legal fees off the defendent.

If you didnt read the Terms and Conditions, then its your fault.
If they broke them, and they owed you money, you would be wanting them to pay you, correct?
You have signed up for something in the ToS, and so should face the consequences of your actions.
We learn from mistakes, and youll learn not to get out of your depth when you dont have any financial backing.
No sympathy

Nick. We have said many times to you. We are willing to work out a payment plan for you. Trust me our last resort is to send you to court or put your account up to a collection agency. However this is non of these peoples bussiness. I know you are needing help and we are willing to work with you.

Look, im sure you can resolve the problem ammicably.
I suggest you carefully read the ToS from start to finish, to ensure that you are or are not entered into a contract.
Should this be taken any further, then you should seek legal advice.. As much as I'd like to say they do, the people of Habbox don't know much in that department.

Around $100 last time I read upon it, but they never really get to trial as they find they can solve it usually. This is pointless Nick, you broke the TOS so you should pay, although the company is a pile of rubbish if they do take you to court then I hope they win.

If you were to go to court you would most likely have to pay attorney fees, court fees, and any travel fees if they win.
Motion
26-07-2006, 08:49 AM
Nick, i highly doubt they would take you to court, but if you have the money then i recommend using it to pay your debt.
Josh-H
26-07-2006, 08:53 AM
Well, if you are in a legal contract then you need to pay it. Its your own fault. That document could stand in court along with the T&C and you could end up with paying it anyway and paying your legal fees.
And tbh even if you win, your legal fees will be over £55. PAY IT.
Flauvo

All I can say is it's your own fault.
Always read TOS and T&C

Nick is in the process of getting the money, we all no he didn't think long term or read the t&c , but little support would be great :)
its not Hugoton being the bad guy, its there datacenter. so enough with the down talk about nick and hugo and a touch of support would probebly be much more apprieated

I also think nick12 your a liar. You told me that you were in university and that you were on a dedicated server paying 50 GBP for it monthly and that you earnt around 100 GBP monthly. If you really are why not pay your debt of with that?
Anywayz I hope you don't have to go to court or pay it :).
awelsh
26-07-2006, 09:07 AM
dont pay them. I think hugoton has no money because they cant give me my refund for £10. also i think they broke their TOS when they promised 99%uptime
Motion
26-07-2006, 09:09 AM
awelsh Very good idea.
Nick12 you could quite easily state that you will not be paying it due to less than 99% downtime.
timROGERS
26-07-2006, 09:12 AM
Now, here is some advice to all budding hosts: NEVER EVER MAKE UPTIME PROMISES! Nick could argue with that, and he'd win it easily. An uptime percentage is not a rough estimate - if it turns out to be 98%, then your *****ed as all you customers could report you to the OFC (Office of Fair Trading).
Evasion
26-07-2006, 09:12 AM
Good idea. Just email them back and say "I refuse to pay this fee due to you promising 99% uptime as stated in your TOS. Therefor I will not pay this fee".
