Um, just to clear up:
Anything work completed by an individual/group, that is working for Habbox and it's sister sites at the time of completion, that is uploaded to Habbox or it's sister sites, becomes property of Habbox due to it being stored online within our paid webspace.
By giving Barkseh authorisation to use the layout, you allowed him to upload it to HabboxLive and therefore transfer ownership claims to Habbox.
I'd appreciate it if this topic wasn't dicussed any more as, as far as I am aware, I has been posted in as many forums as possible, and PM'ed to me, MAD, sierk and 8Freak8 who will all give the same response.
Now let's go about getting this closed shall we?
whats the point in closing just means i have to make a new 1 lol.
can you tell me in the rules where it says if its made its habboxs

I'ts true, its like any other website..
Tbh its like saying you submit a article on Habbo, they show it but you no longer want them to, but they wont remove it obv.

You did not contractually release that to Habbox and you charitably donated it to us. There were no terms that if the radio manager were to change the offer of the skin would be rescinded. You have no legal or moral ground to make the demand or claim to the skin. Nor do you have it copyrighted, though on moral grounds you do have the right to be credited, but on moral not legal grounds.
And for the person who said its like daylight robbery, we never said we own it, but we do retain the right to continue displaying it, though I think others should reserve the right to be credited for the work, however allowing people to take their work with them when they left would leave sites in shambles ;)

While Adzeh does know alot, and could be right, he is not the official representative of Habbox Management. He could have simply misstated himself or be misinformed. Equally, I could be misinformed. We will not, I supposed, know the actual policy until 8Freak8 and/or sierk intervenes but yeah ;)

Your wrong actually, because when he made the layout it is automaticcaly copyrighted, and is his work. Therefor, you can only use his work for your own personal use, other than that - you need his permission to display it online and kinda make money from it..

How is it automatically copyrighted. You have to apply for copyright I do believe. Also, he submitted that work to the entity of Habbox, by granting his permission he allowed us to use it and furthermore we retain the right. Did he in any way shape or form say at the time the skin was uploaded that the conditions under which he released it to Habbox was that it would only be used while Barkseh was manager?
Nothing is ever automatically copyrighted. Infact anyone could use that layout because neither the webpages nor the source code has the required copyright notices located within the document.
Secondly, the layout doesnt make us any revenue, revenue is generated by the sale of services that Habbox as an organisation offer to their members for which they pay for or 3rd parties pay us for.
Oh and by copyright law because you have created this layout for another person without branding it yourself and I doubt you created documentation that stated that Paul was not allowed to copyright it himself you actually transfered the rights to him. Considering that Barkseh had used it on HabboxLive which is not legally owned by him nor had the layout been copyrighted previously by you or (if barkseh was allowed to brand it himself) by barkseh it means that technically we are not infringing any copyright laws.

If every staff member that left and said take my layout off, or remove my work, then no fansite or site would ever stay in tacked. Sorry but I doubt it will be removed until someone makes a better one :).

Therefore if you decided to take it to court (which I know you're not threatening to do, but if you did) you would lose because we would say (and provide evidence) that you gave us explicit permission to use it under no terms.
Habbox doesn't remove work created for us after a person resigns or gets fired, because it would cause too much disruption and have a negative affect on other workflow.

Actually under British law, on creation of any item (including digital works) You are automatically granted full copyright as the creator. No futher action is required . If they created it, they owns the copyright. Hence since you haven't specifically licensed it from the creator, under any formal contract, it is completely within his rights to say whether or not you can use his works, unless he has already entered in to a contract saying other wize, or agreed to wave his rights.
Since this was an informal deal, made on good faith alown, The legal rights will always lie with the copyright holder.
Note: going to caugt would be an act of stupidty none the less, becuse it will cost ALOT and you wont really gain anything, other than maybe habbox haveing to take down the layout (that would really be worth a few 1000 pounds of legal fee's o.0 )

Ironically we are in the market for a new layout, however I don't want Peter to think he has 'got one over on us' once we soon take the old one down :D.

I (DJ-Cookeh) made the layout for the use of Barkseh; now that Barkseh is no longer part of Habbox, I do not give you authorization to use it within Habbox.
