View Full Version : Can I take legal action on....
Well, I bought a domain from NS-Hosting, I have had it for about 2-3 Months, and then shut down (I Paied Yearly) Not only they took my hosting away, they took my domain. I paied them more than its worth for the domain, www.crazyhabbo.net (http://www.crazyhabbo.net) and they wont give me it or change name servers. I have bought a bloody forum domain www.crazyhabboforum.net (http://www.crazyhabboforum.net) and Other things are licenced to that domain. When I talk to them on MSN about it, they ignore me. Can I take legal action and Sue them as they ripped me off when I paied for 1 year, not 2-3 Months. This makes me feel depresed, and un trustworthy of any host again :(

No point to be honest. You shouldn't have to pay legal fees because there is legal aid for things like this. No point

It would cost more than £500. It costs around £2000 to hire a solicitor for the day (even if the case is only 30 minutes, you pay for the day usually).

Agreed. Also there is no reason why they should simply get away with it. Hmm, well paypal was used there is a scheme but I believe you have to make the claim in the first 45 days of the purchase. However you could always try that. You can make claims if you made the payments for items. If you provide proof etc. in a claim and tell paypal what happened they may refund you in some way. They'll basically just steal the money from them if they are found to be in the wrong.
I've done it one or two times to poor companies that didn't provide the service right and have got my money back 3/3 times.

However unsuccessful as my site is at the moment, I have alot of projects lined up, and last month averaged £37 per hour, working about 3-4 hours per week.

I think its ridiculous that he thinks he's going to court over a £5 domain. I got £395 scammed off me on eBay, and I got that back within one and a half months. If you have a real claim, go ahead, but a domain for gods sake?

Recommened not to go to Court! can end up in time fees! Just see if you can come to a agreement with owner if nothing changes then take it to court but its a 50/50 Chance of you winning!. If you bought the domain and it stated on the site at the time that it was closing at a sertin date then you will have no chance! but goodluck withit

It might of taken you ages but it's a chance to build a new one and make it better, for cheaper then court fees.

If the domain was taken off you without your permission, you have a right to SOME compensation (or something like that, that's what them lawyers on TV say).
Basically, taking them to court is not a smart idea...

In the time to post that, he could have renamed the files.
You shoudlnt host with people, you should host with companies, andread their T&C. Im sure, if you read it, they would have said that they could close them at any time, with no refund given (if the had half a brain)

Have a look in their terms and conditions and ensure that they don't already have a policy regarding this issue; i.e. "..We reserve the right to terminate hosting and domains without prior consent from the owner, we may or may not give a refund or credit note.." or something along the lines of. If they do have a policy then there isn't much you can do.
If they don't have a policy then ensure that you have proof of purchase; this could be an email from the business. With this email you can sue them under the trade descriptions act 1994.

- you should of had a contract with them saying it was yours for 12 months. did you have acess to it or did they buy it off namecheap and give you partional control, if it was partional control then there probebly isn't anyting to do with it.
the big thing is that uk laws cannot protect you if you buy from an overseas seller including online, your have to check international law
as for the people who keep quoting the trade descriptions etc.. they won't work if the 'company' that he bought for wasn't registered. ..
the biggest thing to do is just to acept the loss and watch sites where the domains you owned could be sold and post there to get there attension

Thats why I've been debating for months on the Comment Is Free section of the guardian on Human Rights, Religion, Gay Marriage, down to Saddam's trial, and how I think it was unjust, again, back to the humna rights.
Thats also why I've been debating with Organ Donors, and people who need organs within the next 11 months, against people who say its a bad idea.
And when I turn 18, as my mother isnt confortbale with it, and I would need her agreement, I am going to get a donor card to be a registered organ donor
