Do i have the right to ask someone to remove a template.
As im sure most of you are aware.

my site
www.habbohallway.co.uk (http://www.habbohallway.co.uk) - its template was stolen completly

Even some of the pages were stolen such as the "Page Not Found"
Other pages such as Home, the DJ of the week everything was taken.
Im guessing it was taken via a Website stealer/ripper such as HTTracker etc.

As its my template and content I have full right to ask for it to be removed... right?

Btw the website which stole it is

Yes, you can ask them or contact their host :) It's a nice layout! I hope you sort it out, and it's no hassle!

There was an massive arguement 2 days ago, And it was proved its my layout. There host is swduk.net but there contact form doesnt work and no-one answers billing though im going to phone them soon.

Check the Who-is details of their host and contact them from that email if no luck contact your hosts host. :D

If you made the template and its copyrighted to you, then yes you can get them to remove it, and if they don't you cna contact there host for termination due to copyright infrigement or take it further you know:)

but you are most likely to provide solid prove you made the template and was uploaded first etc, like screenshots of the making.

Its been prooved in the other thread. The Host arnt very good with replying ive sent in a support ticket and dded the msn support too. Waiting for an reply

Yes if its your template you have the right for them to remove it but if they do, thats a different matter. If they refuse to your stuck as the only other way to get them to remove it is legal action which costs far to much to sue over a web template, therefore if they refuse, your stuck really. :(

Singh do you want me to try and trace it back to the datacenter etc and talk to them about the fact they are breaching the DMC Act? If so talk to me on MSN about it and I might be able to help but I will need proof that you own the layout before I get directly involved. I dislike people who steal layouts but I need proof your telling the truth, not that I don't trust you though.

I hate people who rip templates then pretend you ripped it and then they make up and excuse once they get it removed

Same, those programs are for offline browsing not ripping. Ive know emailed the REAL host and asked for it to be removed. Il wait for an reply now and if i dont get one then go and phone.

Edit: I just realised that the email from Whois of the REAL host, was on my old msn account and is a 13-14 Year old kid. He is currently not applying to my messages.=]

Here are some hints in trying to get their site suspended/having them remove the layout.... I have done it before ;)

-Be specific about the site and which part of the DMCA it violates
-Don't speak in the first person "I think its illegal, they shouldn't rip my layout"
-Sound professional and just say it as it is, dont embelish

Also, if you need any help I might try contacting opensourcehost - he helped me out when I had to write a formal letter to the host.

ok, Ive found the host [Jd-Host.com] and then JD-Host's host is swduk.net

Ive tried to contact both of them buy had no reply :S

Offline Browsers - They are dirty, cheap programs that steal other peoples work and lets the person using it download the files hes looking at. I mean come on who actually use's it for offline browsing?

there seems to be no disclaimer

firstly sulake could sue you
secondly they could kinda reverse it

add a disclaimer and copyright notice
