View Full Version : The school was wrong.

Yesterday, I really hurt my leg in PE. The school said there was nothing wrong, and gave me a warm ice-pack that someone else had already used, as we was on the Astro Turf.
The ice-pack then burst open, and the stuff inside went all over my leg, and all the dead skin fell off and my hands went white.
I then found out today, after being rushed to hospital as I fell down the stairs (because it still hurt), that I tore lots of leg muscles. So now, i'm on crutches, and I have the week off.
I'm tempted to sue the LEA or something... should I, lol?

Try and fund a lawsuit at the age of 14. Make a complaint if you like but I doubt much will change. Get well soon :).

an ice-pack is just water though when it bursts? if it was already warm then I can't see how it would of damaged/hurt you anymore than you already were :s?
anyway, it's your choice but personally I wouldn't bother...

was it your fault it burst?
I can't see how it being warm would cause it to burst, so I doubt you'd get anywhere with it.. if you did decide to try and sue.
Yea, ther quite hard to break. My little cousin cut his open with scissors to eat the magic blue jelly.

No, I mean, the thing is, they gave me improper and unsafe treatment - it was not chilled enough, and it was insufficent as it burst open. The thing I am trying to say is, they refused to let me go, and gave me insufficent/improper/unsafe first aid, and it ends up it was their fault.

Do you have a hypothesis on how the ice pack might have burst?
I'd put in a complaint.

get well soon, but a teenager cannot support a law suit.

The teenager might not be able to but the parents can sue on his behalf cant they?

Would be a waste of money to be honest, I don't see where the strong case is ;).

My Middle school and now my Upper School use blue ice packs with some sort of jelly like substance in. If anyone knows the ingrediants to the Magical Jelly, and It can be quite harmfull, it would be good to know as it would support the reasons to sue further as they did not provide sufficiant treatment.

Sounds like a good claim.
You might not be able to sue them, but you might be able to get a bit of money / apology (my bets would be an apology) if you make a formal complaint to the local gov? Stating everything that happened.
They will also obviously ask the otherside of things to, and if the other side give a different account, they are more likely to be listened to, as they are the adult, after all.

i doubt you'll get any compensation or money off the school..
tbh i'd be mad ;P especially since the ppl who do the first aid for me are the office ppl... and i hate them xD well basically i'd not try and sue but get an apology or a bit of cash :P
You know you could sue if you wanted, ltos of people are saying you can't because you cannot support a law suit, but your parents can represent you on your behalf. i think you've got a good reason for a claim..
one of my mates broke his nose before on a school drain, and i was a witness to it and he was just walking along and the drain was positioned in an arkward place and it was icy, so it was non of my mates fault - he attempted to sue the school and got lots of compenstation, if you go in to sue the school will most likely compensate you anyway because they don't want to fund for a lawsuit in defence

An ice-pack doesn't 'burst' by itself. some kind of pressure must have been put onto it.

Ah well, schools are like that. If you threaten to somehow make this incident public, they will lick your boots :P They want their reputation. In my old school, they were like, don't play on the road or people will think so and so school has blah blah blah students. Their first priority is the schools reputation.
