well 1, i have just changed hosts, 2, i proved my forum is legal by adding it to the link page on vb, and 3, i downloaded 3.5.0 beta the second it came out, and it is now on my test forum

Then its deffitaly illgal, i read threw the licence agreement, and it says quite cleary the licence if for the perosn who buys, it and can not be given, or leant to anyone else, unless you have written consent from them
