It doesn't matter. The console records what games you play and publishes it on your Live account, doesn't it?

That's the one I'm watching, he shows enough without spoiling to much, it's good and the car explosions are amazing xD

So how are Microsoft handling this?
Surely the consumer can't be blamed for a store breaching release dates, however the people downloading the torrent will be treated different.
