first of all, many private servers upload keyloggers
secondly uploading a private server means that you are hosting an illegal copy of a copyrighted game - very illegal - jail time illegal. Not saying that you will go to jail if you use a private server, it is very unlikely, but it is still a possibility. Could lead to lawsuits also.
Don't bother with private servers, they really are not fun, it's more accomplishing to build the character yourself.

actually it is possible because it is considered that your IP Address is hosting the private runescape server, although the laws on validity of accusiation by use of IP addresses is currently under revision. Essentially you are ripping off the code for runescape and claiming it as your own - even if this was not your origional intention.

And of course this will not happen, it is just a possiblility - like going to New York you have a possibility to get mugged, doesn't mean that if you go to New York it will always happen.
