I seem to be able to see habbo's on the picture.
If HABBO's are on the picture, HABBO have copyright over it.

Yes but if habbo took it from the alt, then they have copyright over the image.
Anyway if people are that bothered about it being 'ripped' then habbo could say the same arguement, and claim you 'ripped' the habbos.

Habbo are using it for profit though, unlike alt artists.

It isn't EXACTLY the same is it? There are quite a few differences and I like the official Habbo one better anyway. Even if they did 'rip' it, what's the alt artist going to do? Take them to court? :rolleyes:

Yeah, are those donkey's from scratch or are they stickers/used before on habbo? Because those are also the same.
Is the guy/girl who made it still around? They could have at least asked to use their work, the saloon has no Habbo logo or anything Habbo related on it so unless the guy/girl submitted it to them or gave them permission to use it then they shouldn't be using it.

The Background might not be on sale but it is promoting/advertising something that will profit them (an event it might advertise which will end in people buying furni for the event or a product it might be selling), they don't own all of the images used and didn't create it all, it's as justified as the guy/girl who made the alt to go copyright the saloon and then using the whole alteration (with habbo's pics) to advertise w/e products he wishes to sell, because he owns copyright to the saloon.

If a guy had a McDonald's "Ronald Mcdonald" character on his burger stand, that doesn't mean McDonald's then own the burger stand. The only right they have is to make him take the logo/character down from his stand and sue his ass for any profit he's made since using it.
How do you know habbo haven't contacted the person who made it and asked could they use it?

Just because you put 'END OF' in capitals doesn't mean it's the end of something or that your point is valid.
Something can not be copyrighted on the basis that it has something copyrighted on or with-in it.
On your basis; If i was to go take a picture of myself wearing an 'aero bar' costume.. (not that i have done.. :eusa_whis..) the picture of myself would then be copyright of nestle and they would then have complete permission to go use the picture of me in anyway they wish?.. No, of course they wouldn't.
They didn't own the picture of the saloon just because it had habbos around it, if that was the case then tons of companies would be chucking their logo on anything they wish.
I Think the only other person who realises the same point as me is Beamer185.
Anyway, it's not like the guy/girl will sue but if they didn't ask for permission i think it's a bit low of them (not that we have any evidence they didn't ask).

Of course it makes a difference.
Yeah, i did previously state that habbo would be able to make the creator remove pictures of habbos, but that's about as much legal rights that they do have, they would only have further rights if the creator used the alteration for advertisement or profit, which would be in the rights of sue'ing the creator.

Under Copyright prevention laws nothing needs to have "Copyrighted by blah blah [date] - [date]" on it to be Copyrighted or have to go through any legal procedure to be Copyrighted, the right to copy is to the person(s) who originally created it. People usually put "Copyrighted" to strengthen it but it is not legally needed.
That is different from a patent or a trademark btw, which i'm sure would need it.

Since they have changed it alot, it is technically theirs. So you're saying if you made a habbo alt of a house, then habbo released a background with a house in, they have stolen your work?
REINOUT--D could have given them permissions to "use" his alt for all you know, and even if he didn't... They didn't give him permission to put habbos in his alt. They haven't told him to remove the habbos, and reinout hasnt asked them to remove their slightly similar building, therefore it does not matter.

I've often wondered about that. What if you open up MS Paint, and start creating an image completely 100% from sctatch (i.e.: nothing is copied & pasted, you just draw), then you end up with what looks like a "Habbo Alteration".
Firstly, it wouldn't be an "alteration" as nothing's been alterted if you've just created something, but my main point is, who says what a "Habbo" is? I know I may sound stupid here, but techinically, there's the possibility that an image could be randomly drawn in MS Paint that resembles the image of a Habbo, but what's the techinical definition of a "Habbo"?
And also, if you made an "alteration" like the image in question but with no actual Habbo characters, (so just buildings etc), would Sulake still have the right to claim copyright over that?
I just think it would make an interesting debate :).

Well it wouldn't really be a debate, it would be a simple answer, no.
If the created image has absolutely no reference to habbo, then Sulake have no rights over it at all, they don't own all pixel art.

Well obviously :rolleyes:. My post was asking about pixrl art that looks like Habbo charcters/objects without being actually copied and pasted.

No, just because the Saloon is smaller, doesn't mean its not the same. Say we go look at a picture on photobucket or imageshack. Its small but when you click it, it gets bigger.
Thats probably what they've done. [I can't think of another explanation, cropping it would get the pixels weird.]
And Sulake stole Hank Mccoy's habbo-abs, why wouldn't they steal anything else?
They know they can get away with it. If Sulake DID steal the saloon without recognising reinout for it, then they can get in trouble. Even if he used some of sulake's stuff, they're allowed to. They're not allowed to steal alts, however.

That is like be getting the HABBO logo and stretching and saying it's mine.
No one knows if Sulake haven't hired this person as graphics staff for them..
Or even purchased the item from him.
Just because the building is in with other Habbo images doesn't make it Sulake's property.
E.g: If I opened paint and put a Habbo room in there then C+P a coke cola bottle in there Habbo wouldn't own the coka cola bottle.
Exactly, so unless Habbo have had permission to use the image OR the image belonged to them before he used it they have ripped it.

probably said before, but in the t&c's habbo says something like they can use all images that look like habbo or something lol
