"Frederik Neij, Gottfrid Svartholm Warg, Carl Lundstrom and Peter Sunde were found guilty of breaking copyright law and were sentenced to a year in jail. They were also ordered to pay 30m kronor (£2.4m) in damages."

I'm going to be honest, they have been found guilty loads of time and been raided. They will continue until they get enough money to buy their own island where they can't be done for their website.

They also have more people working on Piratebay than them.

Well the word Owned is not a nice word to use, I do not think it was good because they was not even hosting the material this will not be the last you hear about this trial more will happen. The pirate bay will always be up and running :)

While only a few weeks ago, it seems like an eternity since the trial of The Pirate Bay Four ended and the court retired to consider its verdict. The prosecution claimed that the four defendants were ‘assisting in making copyright content available’ and demanded millions of dollars in damages. The defense did not agree, and all pleaded not guilty - backed up by the inimitable King Kong defense.

Today, Friday April 17, the court issued its decision. Here are the main points relating to each defendant (continually updated live);


Peter Sunde (born September 13, 1978) alias ‘brokep’:

Verdict: Guilty - 1 year in prison, damages to pay: $905,000





Fredrik Neij (born April 27, 1978) alias ‘TiAMO’:

Verdict: Guilty - 1 year in prison, damages to pay: $905,000





Gottfrid Svartholm (October 17, 1984) alias ‘Anakata’:

Verdict: Guilty - 1 year in prison, damages to pay: $905,000





Carl Lundström (born April 13, 1960)

Verdict: Guilty - 1 year in prison, damages to pay: $905,000





The court said that the four defendants worked as a team, were aware that copyrighted material was being shared using The Pirate Bay and that they made it easy and assisted the infringements. It categorized the infringements as ’severe’. The judge said that the users of The Pirate Bay committed the first offense by sharing files and the four assisted this.

While the court did not agree with the plaintiff’s exaggerated estimates of losses, it still set the damages at 30 million SEK ($3,620,000). This a hugely significant amount and the court has ordered that the four should pay this amount between them.

The judge also stated that the usage of BitTorrent at The Pirate Bay is illegal. Rest assured, other torrent sites hosted in Sweden will be keeping a close eye on developments.

The defense put it to the judge that he had folded under intense political pressure. The judge denied this stating that the court made its decision based on the case presented to them.

At one point the judge was asked if he was concerned for his personal safety after handing down this decision. The judge said he hadn’t received any harassment and was quite surprised at the question.

Peter Sunde has already explained that this decision does not mean the end of the line in this case. There will be an appeal which means we are still far away from the ultimate decision - possibly years away. The case is now expected to move to the high court. Both sides have three weeks to file a written appeal.

As for the fate of the site, Peter has already promised that The Pirate Bay will continue. The site itself was never on trial, only the four individuals listed above.

the website servers are placed all over the world. in countries with favourable laws. I think one is even in Congo. They aren't going to prison yet though, they are appealing, and then will probably appeal to a higher court, then probably to the European Courts.

I read somewhere that they have servers in at least 10 different countries and if they get raided like they did last time the site can be back up within minutes. It will be a while before TPB dies if it does have to go.

Yeah its not a big deal to them im sure they have been sentenced to jail in the past because of this, they will still run there site im guessing

I don't really see the point in prosecuting the people behind the site when it's evident the sit wont go down. Clearly the companies just want repaid rather than the piracy to stop, at least that's the way I see it.

lol you can get like 14 years for being caught filming a film in the cinema and thet get one year for owning the most popular site for torrents

probably because they don't actually host anything but still lol, good to see websites still up though I wunna catch the new Wolverine film

Well I suspect it's a case where ideally they would get rid of it forever, but in the absense of the possibility of doing that, they settle with getting some money to make up for it :P

The thing is I don't thing the pirate bay are doing anything wrong to be honest they are not hosting any illegal files on there servers just the .torrent files which are a few kb's

I've downloaded all my music from there and because I have hear'd the music then I then go any actually buy the CD sometimes.

I also download TV shows which I have missed on TV

At the moment I am downloading my name is earl episode 23 :)

The irony lies in the fact The Pirate Bay always use Swedish law to defend themselves against companies complaining, saying Swedish law doesn't find it illegal: http://thepiratebay.org/legal.php

But now Swedish law has changed... The pirates have been plundered. Aaargh.

The worst part is that US corporations pressurised sweden, a developed country, into changing their laws in order to get this trial through.

Piracy is illegal, but since the record companies are refusing, or at least moving very slowly, to keep up with the current trends suing TPB will do nothing.
