I work in a restaurant and had my phone confiscated last week sometime, this isn't the point. Yeah ok i know I wasnt allowed my phone but i did have it on me due to personal reasons. Got caught on it and got it confiscated.
I could tell they'd tried to get onto it because when I got it back there was the message you get when it's locked itself because of too any incorrect passwords.
I then today got told that two of the duty managers had gone through my messages (to someone who doesn't even work for the company!)
Are they allowed to do this? Because I see it as a complete breach of confidentiality as the messages were personal and weren't even to anyone they knew.

Nope but it's not something you can prove and how would they get to the messages if they didn't know the password

they both admitted it to me today, but i have no idea! that's what im really confused about but they were saying messages that i'd sent and what time i'd sent them

Afaik it's not allowed if it's via a personal phone (not one the work has paid for, same goes for any personal property such as your bag), although I think they might be able to be able to look at it under certain situations (like if you've taken pictures while at work) but then they wouldn't be able to just look through your phone without your permission to see that.

It is a personal phone with personal messages on! a close friends family member was in hospital so I was trying to keep in touch with them and cheer them up but they had no right whatsoever to look at my stuff! I just dont know how they got my password
That's something that would happen at my school lol. I didn't even know a workplace could confiscate your phone. Wouldn't they just tell you not to bring it to work or to keep it in your pocket/locked in the office until the end of the day?? Also the fact that they admitted to going through your messages, I can't belive that either, I'd say that's totally wrong.

I've only been at the place two weeks and I want to leave. I just dont know what i can do about it!

If they wanted to look at your phone they would need permission first. If you did give permission you would need to be present.
we're allowed our phones on us at work for the same reason u had urs on u

yes what they did is wrong
I wouldn't sit back and let them get away with looking at your phone. It is private property, and they had no right to look at your messages.

That is so wrong omg. They aren't allowed to do that, I don't know what you should do though. Depends how far you wanted to take it?

I doubt they're able to look at your phone without your permission. Maybe if work had supplied you with the phone (but they hadn't). Can't believe they took it off you if I'm honest - if I worked in a restaurant I would just tell them to bugger off :P
Depends because they could always turn around and say ' we suspect you are doing this' but them knowing the times is probably checking how much you use your phone at work?
But as its already been said they have no right to do it without you present and without your permission. However you will have no way you can proove it.

Thing is they are allowed to take your phone but not looking at it which invades your privacy. You can report it.
