My friend crashed my car

Hi,

Gah didn't think i'd be doing a post about this, but now living abroad I've lent my old car to my friend (for him to pay it off month by month)

Now i've been here for 6 months or so now, and he's had about 8 crashes... (before the comments come, this car was prestine, no scratches, dents nothing)

Now its borderline written off, not sure if he will carry on paying, so I realistically need to do something about it.

What I am wondering is, can I claim on his insurance if he doesn't?

So he's insured for the car, you're the legal owner and the credit is in your name?

You're just relying on him to pay you monthly to pay them?

No, the car is owned by me, he is just paying it off (essentially its financed to him)

I take it you got him to sign an agreement and stuff that he would pay the full amount (even over periods)?

So long as you have his signature surely he will have to pay off the remaining cost of the car regardless of whether he has damaged it or not?


Edit: okay I read it wrong, it was just lent to him for the duration of you being away?



Sounds like a tricky situation really! I don't think there's any way you can claim on his insurance though :(

Unless you have a contract, he owes you £0. If you had the car insured you could ask your insurance if they will cover it but you are just increasing your future premiums.

What you should have done is made up a proper agreement stating monthly payments and what would happen if he was to default on his payment or damage the car. But as it was a friend we don't tend to do this and work based on trust.

Who's name is the car registered? Was the title transferred? Do you not watch Judge Judy?

It seems unless there was a binding contract, your friend owes you nout. Unless he's a decent friend.

If you have evidence of this agreement then it's possible that would be sufficient evidence of a contract. Not everything has to be on paper.

ohh rosssssssss why would you let a friend drive your car for a week let alone months on end

and if he hasn't told you each time he's had a crash then that gives an indication whether he's the type of guy whos gonna pay you back

Yeh he's told me every crash, but they are just dumb crashes. I let him drive it as I have no use for it, I can't sell it being abroad, I can't be bothered selling it. I assume he will carry on paying to be fair

Oh no that's terrible! Hopefully he does pay for it because if he doesn't then that's out of order :/ x
