So if the mod is clever enough to remember the T&C they can perm ban you under 2.3 / 2.2 of the T&C - Happened to me once.

i got banned on .au for saying that :l its crap i actually wasn't going to do anything wrong for once (i used to script on it) and i go on cause its the local hotel and i get banned :l

I got banned under 2.2 of the T&C on .com.au for adding beamus to my console when that script was working lol, I got unbanned because i argued with the player support

well, i would be unbanned but: i dont know my email :D and then d.o.b :P
