It really is.. it's a filesharing program, if it was completely illegal it would have been shut down ages ago (everyone knows about it), but the fact is that downloading music isn't what it was primarily made for. The terms of service say that you have to use it for legal purposes (such as sharing documents, pictures and self-made audio/video files), and the program and its owners are in no way responsible for you breaching that contract, hence why it is still legal in essence.
