    Default should i appeal to my ban??

    ludus banned me a while ago, i believe i was wrongly banned, he makes a lot of fuss about pictures HE posted to the internet, and me saying he takes pictures of boys in their underwear (which he has on his facebook), and by boys i mean guys, men, blokes, whatever , i didn't give an age, but he assumed i meant it as little boys
    it's my 3rd ban and i got told i wouldn't get a ban lifted after my 2nd time, but this is unfair so WHAT DO YOU THINK GUYS
    here's the email from a while back:

    Hi Habbo,

    Thank you for your recent email.

    When placing bans, all issues are investigated fully with attention to detail to avoid miscarriages of justice. When a Habbo appeals a ban, the matter is reinvestigated and in the unlikely event we have made a mistake, it is rectified.

    I have reviewed your ban appeal and it is being firmly denied for the following reasons:-

    * Your activity in inappropriate Habbo websites (scripting communities) is a cause for concern. We do not want our users to be on such websites violating both the extremeties of our Terms and Conditions (such as scripting and hacking), confidential information (such as leaking personal emails received from Habbo Staff) but most specifically the thread you created on one specific website under the username '*****' which states:-

    "Guess witch hotel staff this is..." created on the 15th April 2009.

    Here you have published images portraying them as a member of Habbo staff. The photos are not of the person you are claiming they are and not only are you violating our privacy, you are violating the privacy of an innocent person by posting their images in a defamatory manner.

    * Inappropriate threads created in the Habbo discussion boards:-

    These posts are deemed as gross misconduct in which you are alledging a member of Sulake staff takes pictures of minors in their underwear - in a public community space. This is a very serious, and unfounded allegation to make which makes you liable for civil proceedings in UK courts, should we wish to take this matter further. The other posts are again defamatory and deemed harrassing.

    * Your previous account history is a cause for concern. You have been unbanned twice on a second chance, and now unfortunately it is obvious that you are no longer prepared to follow our rules. These old offences included advertisment of fake Habbo websites (designed to steal other player's accounts) and you were given a benefit of the doubt with a last chance on a sexually explicit behaviour ban, in which you were advertising explicit web cam conversations with other players.

    Your licence to use Habbo UK has now been irrevocably withdrawn and you are no longer permitted to use this service for the reasons herein. Any accounts created by you (including those you may register in future) will be permanently suspended from this service.

    Please be aware we take action against an individual, not a specific Habbo account, as this is explained in our Terms and Conditions of Service (should you seek further clarification on this matter):-

    I will draw your attention to the following clause 2.3 which states:-

    "Habbo reserves the right to terminate your access to the Chat Room and Message Boards, or the Site at any time, without notice, for any or no reason."

    I have also taken the time to outline some of the clauses in our Terms and Conditions of Service you have violated, so you can gain further legal insight into what rules you broke:-

    2.1 The Website contains an instant chat service (the "Chat Room") and message boards (the "Message Boards") to which Users may submit messages for publication. The User agrees to use the
    Chat Room and Message Boards only to post, send and receive messages and material that are proper, comply with the requirements of the Website and relating to the Website.

    2.1.1 Use the Chat Room and Message Boards in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or
    otherwise);

    2.1.2 Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;

    2.1.3 Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information;

    2.1.8 Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded; (this relates to your creation of fake Habbo sites)

    2.1.9 Restrict or inhibit any other user from using and enjoying the Chat Room and Message Boards;

    2.1.10 Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service; (this relates to the Habbo Way which you can find by visiting www.habbo.co.uk/help/22)

    2.1.11 Harvest or otherwise collect Personal Data (as defined below) about others, including email addresses;

    2.1.12 Violate any applicable laws or regulations;

    2.1.13 Create a false identity, or impersonate any person or entity, for the purpose of misleading others;

    2.1.15 Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of the Website or other user or usage information or any portion thereof.

    I wouldn't bother. They have got you firmly shut out. There is no way they will unban you. If you try to appeal I fear it will only provoke them to take the proceedings to court.

    I highly doubt that they will unban you, but as it is under new management I feel the best way to actually know whether or not they word is right a formal letter containing apologetic terms.
    Also, if you were going to bend the rules so many times why not use a clone?

    Skipjack - I guess the thing to ask yourself is a) have you changed and b) does your recent behaviour on accounts which aren't banned show you've changed?

    Your history on skipjack doesn't make pretty reading so to stand any hope of clemency you'd really need to be able to prove you have changed and you've become a pleasant player ;-)
