Yuk! Just got a new N96

Just got my N96 back, after claiming on the insurance.

Coupld of things, the battery is mm's too big and so the back isn't totally in place on the left hand streight. Is this normal or have they gave me the wrong battery?

And they replaced my fully black one (which when i bought was told was the latest one with new firmware etc on), with a silver border one which at the time of purchase was the old one. could this still be the latest one with new skin?

and now the buttoms make sligh squeek as pressed which makes the phone feel tacky, something i didn't experience at all with my first one.
