Anyway you were NOT the first to use an iPod media player and I can name atleast one site which used it before you.
You dont own any piece of copyright over the image or script so just get over it.
Its not like people remember your site because of it. If it was a unique feature then yeah I would care but not when its just an iPod which many sites have used before you.
