I wouldn't say that he has to do the upgrade to prove that its not illegal, as my forum is still on 3.6.5 I think and I do hold a licence.

He could post a screeshot of his members area though, or maybe prove some other way.

I got this when I advertised my vBulletin forum. There will always be a suspicion.

Just post a screenshot of your members area and black out the personal bits people dont need to see then everybody will be happy and leave you alone
