The teenagers that attempted to sue McDonalds had the case thrown out and the "Cheeseburger Bill" (nickname, the real one appears to be called H.R.554 for the 109th Congress) was passed which means that you can't sue Food or non-alcoholic drink sellers or producers for making you fat. That was in 2004 so it's hardly recent either.
McDonalds is not at fault in this case unless the photos were uploaded by a representative of the McDonalds corporation.

Someone could just steal the phone from mcdonalds just after they leave? :S They wouldn't do it on purpose, because they wouldn't know it would appear on the internet, idk.
