There was something on the BBC actually about how hackers are getting younger, and they not good enough so they can be tracked easily. So they just get pwned LOL.

Find their IP, do a WHOIS and then report them. Or you could take them to court or something somehow for breaching the data protection act.

In many terms and conditions, people will add a clause where by it says you agree for your details to be passed on.
You are then aloud to sell on the emails.
Basically it depends on the conditions of how the emails were recorded
