Copyright laws are irrelevant, vandalism is the only relevant one and to an extent both companies have suffered defamation although it amounts to very little and it's unlikely it'll come to anything.

However just because the colours are wrong doesn't mean it wouldn't fall under copyright law, for instance if you were to release a product with the Windows logo but the colours the wrong way round, or if it even looked at all similar to it, you could still be prosecuted under copyright laws.
