To be honest its no where near the same. Ripping is taking the exact layout and using it, saying they made it maybe altering a bit of it.

It seems like that person made it from scratch, using ideas from that site anyway. He only has the top and bottom looking the same, so its not really ripping.

The new VISTA system looks like Mac OS X, doesn't mean it's 'ripped' or that Apple could sue them because they might have copyz0rd some of the elements of their designs.
