Well he has changed the IMEI on it now and it works fine for him.
He didnt steal it, neither did I. I have no choice whether he gives it back or not its not my decision is it.

Would the person it was stolen from get a new one for free as there on contract?
Why would it have to be a busy place? Could of fallen out of someones pocket on a field just as easy as a £10 phone would of.I once found a £10 phone on the fields - no one round so I thought I would pick it up, instead of leaving it there to get damaged by weather.
An iPhone on the other hand is a different matter. It is worth a lot of money, and for it to be stolen, you must have found it in a pretty busy place...
