"Habmate DJ Cpanel" - Hmm...

Hey,

I've been requesting the staff at HabMate to fix this issue since around late Saturday/Sunday and they STILL haven't fixed it.

Their "amazing" Radio DJ Panel which they called "Habmate DJ Cpanel" was 100% ripped from the Panel I produced and released for free and they have claimed it as their own creation.

You may think, so what? I don't care?..

Well I do. So I just thought I'd post this and tell them if the original copyright isn't put back tomorrow, their reputation might not be the only thing which is going (I'm going to file a DMCA Complaint).

It all depends what you licensed it under. If you licensed it under the GPL then your screwed. You should always license any free software you release under a Creative Commons License because it gives the interlectual copyright to the creator.

Since you in no way included instructions as to what they are allowed to do with the piece of software then I believe that they can do as they like with it since if they change any of the source code it instantly classed as a different piece of software and so is no longer your interlectual property.

The issue is that Invent didnt license his work so you can do what you like with it since when you downloaded it you never agreed to keep the copyright notice on the panel. So it then comes down to courtesy. Do you care how much time he put into the project and want to tell people who actually made the script? The balls in your court.

I forgot to mention inside the script that it was released under the Creative Commons License (Attribution).

I have since told people that are using it, that it was released under this.

You havent had to pay for interlectual copyright since the begining of the 20th century :eusa_wall you automatically get it. You pay for patents etc but not copyright thats automatic.

This is why I never release anything opensource and I keep control on who uses it and who does not. Also if you never mentioned it was licensed under creative commons, when they downloaded it (e.g it says in the panel the license its under or a copy of the license is included with the download) then you have 0 protection.

Here's a little advice that comes from previous personal experiences with rippers...

Now I didn't bother to read the whole thread but basically all you need to do is find their host, and write them a nice little email telling them what kind of license this breaches... now also remember that unless you distributed the panel under some sort of license terms that requires the copyright then you're kinda out of luck - it must be clearly stated in your terms when they download it or w/e that the copyright must stay in place - or it must atleast be clear that it is distributed under a creative commons that requires copyright to stay intact.

Just give the host a link to the offending site, proof that its really yours, a link/text from the actual license, and if the host doesn't comply then you can always try "the hosts host" - in other words do a whois type thing (I think its called a traceroute) on the hosts ip/domain and then contact their datacentre and they are usually pretty good about shutting down offenders quickly.

So ya.... hope this helps :)

Anyway, its basic principles why do you care if they changed it its just some crappy habbo fansite it doesnt affect your status you made it open source your gonna have to face the consequences if you dont want people to change it dont release it open source or implement a liscencing system but that would really miss the point, so if you want to keep it open source stop complaining, theres going to be cases and i dont see what people achieve by changing this anyway making out like they made it whats the point what do you get from this so you could of just sent the site owners a email or something and done this quietly no need to make a big fuss about it.

Well now, if HabMate did take the not copyrighted panel, claim it as theirs there is no real law about it though, it is rather morally wrong.

I think your best bet is to just keep complaining to them and telling the community about it until they will have to respond to you.

This issue will be sorted asap. I will compare every script with what is in the habmate djcp to the one in the old radio habbo dj cp to check whats what.
The layout of your powerpanel which craig let me view as admin on your server is almost identical to the old rh one which was out well before your panel. I admit its also very similar to the habmate one apart from the habmate one has more features than your panel.
I asked the person who built most of the rh djcp to do the same here so cant get my head around why he would rip yours.

Once I have checked the script either we will remove any that are identical to yours or your copyright will be re added as requested.

I have not heard of powerpanel until this issue was brought up but saying myself and Catzsy dont care is wrong.

I was the one who organised all of that by asking the guy who made the rh panel to sort it for habmate.

Also I can see lots more features but only i have access to them to stop other admins touching them so I can see whos done what and when with a full log system for everything in the panel and by who.

If there are still any old rh dj's about that view the habmate panel they would instantly recognise all the features from back then including the navigation. The panel at rh was never released but most features got ripped from us and ended up on most other sites.

I promise you this will be sorted out asap so perhaps calm down a little because if anything turns out to be ripped from you I would happily remove it or re add the copright.
