We don't know exactly what the circumstances are, but lets assume he was simply standing there when the Police arrived - had he refused to surrender his weapon and be arrested then sure, he ought to be shot at. If not, then he shouldn't have been shot at and ought to be put on trial.
It always perplexes me how people who oppose the death penalty (a civilised method of administering justice) are always the first ones, in the event of a terrorist attacks, to demand ridiculously over the top and Police state-like measures to deal with it - ie, shooting suspects on the streets.
