If it doesn't say that you can re-sell the layout, then you cannot.

T&C's are there for a reason.

It's a lawsuit if you break them.

Even if you have got a better layout for free, you cannot sell this one.

Plus, it's a great layout that you got from a P2P network.

To me i think you have got it from a Warez site. I think i know where the layout is bought from. If i can find it i will contact them to see if this is legal.

I have contacted them about this thread. Why should people pay out for $64 while you get it from a warez and resell it ?
