The 40GB console is not supposed to be backwards compatable with PS2 games. It does play some PS1 games but it's not supposed to do PS2. Maybe some of the games just work randomly because they have different disc encryption to other PS2 or they're PS1 games in PS2 cases?

The only backwards compatable PS3 is the 60GB console. The 80GB or 160GB console are not compatable with PS2 games, but will probably play some PS1 games.
