Should the employer be liable for an injury on the job?

Picture this. You're on a ladder fixing a hole in the wall. You lose your balance, and you take a high fall. Your leg is broken and now you've got a dilemma. Who pays the medical bill? Will it be your employer who didn't follow proper safety precautions by caging you in as you get up to do your job, or is it your fault for losing your balance? That's a real messed up day my friend.

In all seriousness, who should be liable if an employee is injured on the job? The employee or the employer? Let me know with your reason why.

There would be no bill because I'm scottish and have the NHS to deal with that.

The employer is liable and the employer has employer liability insurance to cover such an incident.

Depends on everyone's insurance details, but generally any compensation will come from the employer (technically) with their insurer actually doing the paying out
